The Aufenthaltstitel is the legal basis for any lawful stay in Germany. It is issued by the relevant Ausländerbehörde and is either time-limited or open-ended depending on the purpose of residence. Without a valid permit, neither employment nor permanent residence is legally possible.

There are several types of permit: the visa (short stay), the Aufenthaltserlaubnis (time-limited, tied to a specific purpose), the EU Blue Card (for highly qualified workers) and the Niederlassungserlaubnis (permanent). The right permit depends on your country of origin, your reason for staying and your personal circumstances.

What is the difference between an Aufenthaltserlaubnis and a Niederlassungserlaubnis?+

The Aufenthaltserlaubnis is time-limited and tied to a specific purpose. The Niederlassungserlaubnis is permanent and allows any employment — it can be applied for after 5 years of residence.

How long does processing take at the Ausländerbehörde?+

Usually 4–12 weeks depending on the city and workload. Berlin and Munich have significantly longer waiting times than smaller cities.

What happens if my residence permit expires?+

You should file a renewal application at least 6 weeks before expiry. Until a decision is made, the permit is deemed provisionally extended (§ 81 AufenthG).

Can I stay in Germany while my application is pending?+

Yes. If you filed a renewal or change-of-purpose application before expiry, you may remain legally in Germany during processing.

Do I need a lawyer to apply?+
