§ 21 AufenthG: The Self-Employment Residence Permit
The Aufenthaltserlaubnis zur selbstständigen Tätigkeit under § 21 is the primary permit for entrepreneurs and freelancers. Key requirements: a genuine economic interest or regional need for the planned activity, positive economic impact (jobs created, innovation potential), financial viability (adequate capital or funding commitment), and secured livelihood from the business.
As of 2025, there's no fixed minimum investment threshold — instead, your business concept is assessed individually. This gives you flexibility but also means a well-argued, convincing business plan is essential. The authority wants to see market viability, not just enthusiasm.
Freelancers vs Commercial Entrepreneurs
Freiberufler (liberal professions — doctors, architects, journalists, IT consultants, certain engineers): The application focuses on professional qualifications. Foreign degrees may need to be recognised first. The category of 'liberal profession' under German law has specific criteria. Gewerbetreibende (commercial business owners): In addition to the residence permit, you'll need to register your business at the Gewerbeamt, and some sectors (hospitality, healthcare, skilled trades) require additional licences.
What About the EU Blue Card?
Blue Card holders are generally not permitted to engage in self-employment — the card is tied to salaried employment. Minor side activities can sometimes be authorised. For sustained self-employment, switching to § 21 is the right path — typically possible once the business shows financial viability. Holders of a Niederlassungserlaubnis, on the other hand, can work self-employed without restrictions.
